Ask a Personal Injury Attorney – Will my Lawyer Have to File a Lawsuit?

But this is a video in our ‘Ask a Personal Injury Lawyer’ series. And in this series, we're going to take some of the most common questions that we get from our clients and we're going to try and answer them here in this format. One of the questions that we get all the time is, when and if will you file a lawsuit for me? Well, the answer to that question, as you might imagine from a lawyer, not giving you a concrete answer is, it depends.

So if I have a client who calls and their statute of limitations, those are laws that limit the amount of time that you have to file a lawsuit, is approaching close at hand. We might try and file the lawsuit the very next day after they hire us or even the day they hire us in emergency situations. In other cases, we may never file a lawsuit at all.

If we can resolve your case, for example, with an adverse insurance company for an appropriate sum, then we'll do that and no lawsuit is necessary. Between that spectrum of no lawsuit and filing a lawsuit the very first time we meet you is a number of cases. Sometimes lawsuits are filed after negotiations with an insurance company fail.

That can be days, weeks, or months after a case begins. Sometimes lawsuits are filed right away because we need the power of the court system to compel a defendant or defense insurance company to behave appropriately.
