What Kind Of Law Do You Practice?
One of the things we get asked all the time at the Arthofer & Tonkin Law Office is, "What kind of law do you practice?" And then we say, "Personal injury."
People sometimes respond, "What is personal injury?"
Well, we looked at the Google definition of personal injury, and here's what it said: "Personal injury is a legal term for an injury to the body, mind or emotion, as opposed to an injury to property."
In common law jurisdictions, the term is most commonly used to refer to a
tort lawsuit in which the person bringing the suit has suffered harm to their mind or body.
It's an interesting definition, but it doesn't really help you figure out, "Do I have a
personal injury claim?
Do I need a personal injury lawyer?
Personal Injury
What is a personal injury?" So let's start with a little bit of history.
Personal injury comes from an area of law called tort law. In English, tort derives from a Latin phrase, tortum, it means to twist, and as it indicates, it does mean an injury to your body, a twisting injury, or something along those lines.
Now, personal injury law goes all the way back to Biblical times.
It's something that's been with civilization for thousands and thousands of years.
In simple terms, what it means is an injury to your body, something that's happened to your person, now that also includes your mind, your ability to think, and your emotions.
And in rare personal injury cases, it can even refer to your reputation, that's defamation cases like liable for written things said about another person or slander for spoken things said about another person alleged to be injurious to their reputation.
So personal injury claims include all of this, but most commonly, they refer to your person.
Now, within injury to a person, there are a number of different sub-categories and sub-specialties.
You have medical malpractice, dental malpractice, and
Workers' Compensation.
If you will, these are all different lanes on the personal injury highway.
